Power Down Hosting – Usage Policy
1. Introduction
This Usage Policy (“Policy”) defines the acceptable and prohibited use of services provided by Power Down Hosting. By purchasing or using any of our services (including VPS, Dedicated Servers, Minecraft Hosting, Colocation, etc.), you agree to comply with this Policy.
2. Acceptable Use
Customers may use our services for lawful purposes, including but not limited to:

Hosting websites, applications, and game servers

Business-related services and operations

Development, testing, and educational environments

Email services within reasonable and non-abusive limits
3. Prohibited Activities
3.1 Illegal Activities

Any activity violating applicable laws (Indian or international)

Fraud, phishing, scams, or impersonation
-
Distribution or hosting of pirated content
3.2 Network Abuse

DDoS attacks or stress testing without permission
-
Port scanning, brute-force attacks, or unauthorized probing
-
IP spoofing or packet manipulation
-
Any attempt to interfere with network integrity, routing, or infrastructure
3.3 Resource Abuse

Excessive CPU, RAM, or Disk usage impacting other users

Unauthorized crypto mining
-
Bandwidth abuse beyond allocated limits
3.4 Spam & Email Abuse

Sending bulk unsolicited emails (SPAM)
-
Email campaigns that may blacklist our IP ranges
3.5 Malicious Content

Malware, ransomware, botnets
-
Exploit kits or unauthorized hacking tools
3.6 Virtualization & Reselling Restrictions

Reselling, subleasing, or providing “VM inside VM” (nested virtualization for resale purposes) is strictly prohibited

Running or offering VPS/hosting services to third parties from our infrastructure without prior written permission is not allowed
3.7 System & OS Manipulation

Installation of unauthorized, forced, or unsupported operating systems (Force OS) is strictly prohibited
-
Any attempt to bypass system restrictions, hypervisor controls, or provisioning limits is not allowed
3.8 Strict Enforcement

Any violation of the above clauses will result in:

Immediate suspension or permanent termination of the service

No prior notice
-
No data access or data recovery will be provided
-
No refund will be issued under any circumstances
-
4. Fair Usage Policy (FUP)

Resources must be used within reasonable limits
-
Continuous excessive usage may result in throttling or suspension
-
Unusual traffic spikes may be investigated
5. Data Responsibility

Customers are solely responsible for their data
-
Power Down Hosting is not liable for any data loss
-
Regular backups are strongly recommended
6. Service Suspension & Termination
-
Services may be suspended without prior notice for policy violations
-
Accounts may be terminated for repeated or severe abuse
-
Any violating content may be removed without notice
7. Billing & Abuse Handling

No refunds will be issued for policy violations
-
Abuse complaints must be resolved within 24 hours
-
Failure to respond may result in immediate suspension
8. Security Responsibility
Customers must:

Secure their servers (passwords, firewall, updates)
-
Prevent unauthorized access
-
Report vulnerabilities responsibly
9. Policy Updates
Power Down Hosting reserves the right to update this Policy at any time. Continued use of services indicates acceptance of updated terms.

11. VM Provisioning, Downgrade & Bandwidth Policy
11.1 VM Downgrade Policy

Once a VM is provisioned and delivered, it cannot be downgraded under any circumstances

Upgrades are allowed, but downgrades are strictly prohibited
11.2 Bandwidth Usage Policy

Each VM includes a defined bandwidth limit
-
If bandwidth is exhausted, the VM will be automatically suspended
11.3 Suspension Due to Bandwidth Exhaustion

All services will become inaccessible
-
Data will remain safe but inaccessible
11.4 Reactivation & Data Access
-
Customers must purchase additional bandwidth or pay applicable charges
-
Only after payment:
-
Suspension will be lifted
-
Services will be restored
-
Data access will be enabled
-
11.5 Important Notes
-
No free data access after bandwidth exhaustion
-
No exceptions under any circumstances
-
Continued service requires sufficient bandwidth
12. No Refund After Bandwidth Consumption
12.1 Strict No Refund Policy

Once any bandwidth is consumed, no refunds will be issued
12.2 Definition of Usage
A service is considered used if:

Any bandwidth is consumed
-
The VM is accessed or deployed
-
Any network activity is recorded
12.3 Non-Refundable Scenarios

Partial or full bandwidth usage
-
Suspension due to bandwidth exhaustion
-
Customer misconfiguration
-
Lack of technical knowledge
-
Change of mind
-
Policy violations
12.4 Final Agreement

This policy is strictly enforced without exceptions
13. Payment & Renewal Policy
13.1 Prepaid Services

All services are strictly prepaid
-
Services activate only after payment
13.2 Non-Payment & Suspension
-
Failure to pay before due date results in immediate suspension
-
Services and data become inaccessible
-
During suspension:

No data access will be provided
-
No backups or files will be shared
-

Data access will only be restored after:
-
Full payment of all dues
-
Any applicable reactivation charges
-

Power Down Hosting is not obligated to provide data until dues are cleared
13.3 Renewal Policy

Customers must renew before due date

Failure to renew leads to suspension
13.4 Data Retention After Expiry

Data will be retained for a maximum of 5 days after expiry

After this, data may be permanently deleted
14. Data Deletion Policy
14.1 Suspension or Expiry

Data may be retained for up to 5 days
14.2 Permanent Deletion

After 5 days, all data will be permanently deleted
-
No recovery will be guaranteed
14.3 No Recovery Guarantee

Customers are responsible for their own backups
-
No recovery requests will be entertained
14.4 Final Notice

Data loss due to non-renewal or suspension is customer responsibility
-
No claims will be accepted after deletion
15. Limitation of Liability

Power Down Hosting is not liable for:

Data loss
-
Business loss or revenue loss
-
Downtime or interruptions
-

Maximum liability is limited to the amount paid in the last 30 days
16. Service Disclaimer

Services are provided “as-is” and “as-available”
-
No guarantee of uninterrupted or error-free service
17. Indemnification

Customers agree to indemnify and hold Power Down Hosting harmless from any claims, damages, or legal issues arising from their usage
18. Jurisdiction
-
This Policy is governed by the laws of India
-
Any disputes shall be subject to the jurisdiction of courts in Indore, India
